Missing phone

I purchased my phone online last week. It was claimed to have been shipped August 8th. According to customer service the store in Florida that created the shipping label does not have it anymore. I tried to file a claim through UPS but they say they don't have it. How long will it take for Best Buy to file a missing claim? I understand this is their responsibility. I also understand that if I have to wait more than 30 days they legally have to cancel the order. What solutions will I be offered. I'm still interested in the phone I purchased because it was on sale and I see it is still available. Thanks!
