Bestbuy sold me a blacklisted/ stolen iPhone

I bought a iPhone max pro for my daughter in January for her birthday in April. I didn't give her the phone until then. Yesterday when I gave her the phone she tried to activate it and was eventually told the phone was blacklisted. I went to the store and was told by the manager that its nothing he could do because 15 days is over. He told me to call bestbuy online. I called bestbuy online after being on hold for and hour and a half that I needed to contact Apple. I called Apple and she tried to contact the Bestbuy store but no one answered. I don't feel like Apple should be responsible because I purchased the phone from Bestbuy. I'm tired and I just want this phone to be able to get activated. This is a opened box item.

And if you Google bestbuy sold me a blacklisted iPhone you will see this isn't the first time this has happened.

Thank you for registering with the forum, though I wish you had found us under better circumstances. It was incredibly generous of you to purchase your daughter an iPhone 11 Pro Max. Having purchased it in January for her birthday this month, I can imagine how excited you were to finally give it to her! 

 

With that said, I understand that the activation didn't go as planned, as she found she was unable to complete its activation. Finding the device to be blacklisted would be incredibly concerning, so I'm glad you reached out. Under our Return & Exchange Promise, cellular devices typically have 14 days to be returned or exchanged. While I understand and applaud your ability to plan well in advance, this may leave us with few options.

That's sad but I just made a dispute with the BBB also because I need all my paperwork trail.

I returned the phone back to Bestbuy on Poplar ave after someone from corporate told me to. I was told I was going to get a FULL refund but It wasn't. They had the nerve to deduct $45 for a restocking fee which isn't my fault because I would have kept the phone if it was blacklisted.
