Best Buy received then lost my phone, refused refund

I returned a phone that I purchased that came damaged within the required return window. Best Buy received said package. They sat on the return for several weeks. Meanwhile I called them 2 times to discuss the status only to be told it is being processed. No refund. Over a month passes and I receive a package in the mail from their processing center with an empty box and a note saying no phone!! Ok, I watched my wife place the phone in the box. They received the phone and sat on it in for weeks before doing anything. Anything could have happened to it. I called them twice since and each time the customer service rep apologized and says they will take care of and nothing happens. This has been going on since January...please help!
