Restocking fee on cell phone purchased and returned in Alabama

I bought a cell phone at a best buy in mobile, AL with the intention of replacing my current phone that I thought was broken. Turns out it wasn't broken, just some weird power glitch and needed a hard reset. I ordered the phone online via best buy.com and did a pick up in store at mobile, AL. When I went to pick up the phone from pickup section, I realized the factory seal on the box was already broken and the plastic on the phone screen was moved as well but I didn't think too much of it.

Anyways, since I no longer need the new phone, I am planning on returning it this weekend but when I looked at the return policy I was kinda confused on the writing. Cell phones typically have a $45 restocking fee unless returned Unopened or bought/returned in a certain state with Alabama being one of them.

Can someone clarify if my situation calls for a restocking fee or not when I try to return it?

A mod may be best to help with this one. Typically if any box is open, yes, the restocking fee is charged. I am not sure why you received a NEW piece of merchandise where the seal was open.

 

Products are supposed to be NEW as advertised and if it's an open box it's supposed to be advertised as such.

Welcome back to our forums, and thank you for posting your question!  It’s always important to make sure you’re aware of any fees you may be charged when returning your purchases with us, so I appreciate you reaching out to us for clarification.

 

As it sounds like you’re aware, we do apply a restocking fee on phone returns in select states, unless the phone is returned unopened.  This is outlined in our Return & Exchange Promise, which also mentions that a restocking fee shouldn’t be applied if the purchase and return both occur within select states, including Alabama. 

 

Assuming all other terms of our Return & Exchange Promise are met, I’m optimistic your local Best Buy store should be able to assist in getting this return processed.
