Bought a refurbished tv marketed as “NEW”

I purchased a Samsung 85-inch television on 2/9/2023 that was sold to me at a new price and listed as new, only to discover the previous owner's Netflix information and settings setup in the tv. The TV came packaged like new, so I had no indication it was refurbished. Customer service is not helping, and I stay 40 miles from the store I where I purchased, so I don’t have availability to speak with the store regarding this issue. I’m beyond upset because I spend $2-3k a year at best buy, and I’m receiving subpar service to get an exchange. I need to get this resolved, or I’ll take legal action. It’s against consumer law to sell an item as new, knowing it was refurbished. I’ve taken screenshots of the order description showing it was also sold as new in case I need to go the legal route.
