The return period on cell phones is 14 days. If you purchased Apple Care or the service plan you should be able to bring it in and have it sent off for rapairs.
However, I suspect it is a software issue possibly the resut of an application that was installed.
Did it first start happening after you installed a new app? If so was it from the Apple App store?
If it did start after you installed an app you may try removing that app.
If you don't have a service plan you may need to contact Apple Inc for warrenty support.
Also, try going into settings and see if there are any patches or updates.
You may also fix the issue by doing a reset of the phone. Keep in mind that will reset your phone to what is was when you first got it.
