Dont Buy From Best Buy!!!

I bought an Ipod touch "3rd generation," or so i was told by an employee it was a 3rd generation, from Best Buy. But it was really a 2nd generation. Now I cant get any new apps because it wont get higher than ios 4.2.1. Is there any way I could get a new Ipod or a refund or something because of their sucky service?

4.2.1 is the last update for the iPod Touch 2nd Gen so there is nothing to update only 3rd and 4th Gens got iOS 5.

And to answer your other question. No there is not a way to get a new iPod other then trading yours in for a gift card and applying it towards the purchase of the newer model. However the price you get offered will most likely not be worth it. And only way to get a refund is to be within the return period which I can safely say I am sure you are WAY past.
----------ALWAYS check your purchased items for damage before leaving the store. If you never leave the store and check it in front of a employee it removes all doubt that you might have damaged the item.----------
