This is something you'll have to work with the software publisher on, as BB is just the retailer. I would recommend going to their website and looking at their support pages.
As for returning it, opened media is only eligible for an exchange for the same product, not a return, unless defective. To prove to them that it is defective, if you have a laptop, I'd bring it in and show them the problem with the game. They'll be much more likely to allow you to return it.

Your issue is a driver issue, there has been numerous reports of the game from the developers website regarding this issue. Could you try updating your computer drivers on your computer first ( most specifically the video card drivers) and see if you can overcome the issue?
The developer is also very helpful in working with customers to resolve such issues.

Has the executable name been modified? Try renaming it to the original one.
