ipad 3 for ipad 1 under blacktie premium protection

So I bought my iPad 1 32GB  last march. I paid a hefty $250ish for insurance for 2 years.  My iPad is broke.  I spoke to a bestbuy in-store rep.  She told me that I couldn't get an iPad 3 32GB because they are still making the iPad 2.  However, none of the iPad 2 32GB's are in stock.  As a result, the rep told me I could only get retail value for my current iPad 1 (which would be $499, the current price for iPad 2 32GB). 

 

In other words, I can only get an iPad 3 16GB for my iPad 1 32GB.

 

Can a BestBuy rep on the boards here confirm?  When I was being sold the insurance, I was told that I would get a replacement when my iPad broke.  If the current model wouldn't be available, I would get the next model up.  Why do I have to compromise for an Ipad 3 16GB when my current iPad 1 was a 32GB?

Personally, I wouldn't regard getting an iPad 3 as a replacement of an iPad 1 as a compromise, even though the iPad 3 has half the storage capacity. Would you have preferred they replace it with an iPad 1 32GB?

 

You could (possibly) return the iPad 3 16GB to the store, get the value in store credit, and pay the $100 difference for the 32GB iPad 3. Maybe Doug will have a better solution, though. He'll be in touch within a few business days.

According to the terms of the Black Tie Protection plan:

 

“If we determine, in our sole discretion that your product cannot be repaired, we will replace it with a product of like kind and quality that is of comparable performance or reimburse you for replacement of the product with a voucher or gift card, at our discretion, equal to the current market value of the product, as determined by us, not to exceed the original purchase price of your product, including taxes.”

 

We’ll do our best to get you a comparable replacement right in store, but if we don’t have one, we usually offer a gift card for the current market value of your tablet.  You can view the full terms at the link below.
