Bought a Xbox on 12.28.12 (250 mb) and it is not working. Called Microsoft and gave the serial number and they stated the hardware was damaged. I just want my money back. Bought an Xbox before and nothing but problems. Will I have a problem? Original box is gone but I have all inserts and free game

Yep. You have 30 days to return/exchange the product.
