Warranty Replacement Question

I previously had a thread here about the trials of getting my tv fixed and now finally it is being replaced.

 

I went into the store with my claim number to do some research on my replacement options. Underwhelemed is a pretty good description of the list they gave me. 

 

Brand wise, my TV was a Toshiba 42rv530u. Toshiba makes nice electronics. Insigina, RCA and Sharp (some sharps are nice, but not this one) do not make quality TVs. Two LG's are also offered, but both seem like the could be lemons based on reviews.

 

Furhtermore, only 2 of the TV's on the list are 120hz. All have at leas tone less HDMI input, and some are missing things like a component input, which I use. I'd hardly call any TV on the list comparable. 

 

The kicker is, if I'm not happy with any of the TV's they'll give me a store credit for the cheapest one on the list. Which is about 450$ (Seriously, go try to find a quality 42" LCD 1080p at 120hz for 450$. You can't.

 

Anyone here have any insight on getting Best Buy to actualy pony up to the contract, and give me a comparable TV, or at least more credit towards a comparable TV?

Brand is not taken into consideration when finding a comparable model. Looks like the sharp 42in 60hz  LCD is a very comparable unit to your current TV.

I will let more knowledgable people give you the answer but I think you are supposed to get a GC equal to what you paid originally for the item.

Sorry, but those are not "comparable products"

 

Here's some of the language from my plan 

 

"

Products, including those within the original manufacturer’s warranty period, may
be replaced with a new or rebuilt comparable product that meets the manufacturer’s specifications of
the original product, or we will issue you a gift card
or voucher at our discretion.

"

 

So for instance, the TV that they would give me a credit for does not meet manufactures specifications.

 

Further into the plan, we can find this language :

 

"we will replace it with a product of comparable performance of like kind and

quality not to exceed the original purchase price.
Replacement products may be new or rebuilt to
meet the manufacturer’s specifications of the original product at our discretion."

 

I'd say definition of like kind and quliaty would specifically be relative to brand.

I'd rate Sharp higher than Toshiba any day...but that's my personal preference. Brand 'quality' will differ from person to person based on past experiences and such, so it isn't taken into account for a comparable product. The comparable product is based on features and cannot exceed your original purchase price.

Just like your Toshiba, the Sharp is a 42in LCD 60hz 1080p TV with 4 HDMI ports and component/composite inputs. It really doesn't get much closer to being the same thing.
