Mistake of Product

About 1 and so year ago I bought an Ipod Touch 8gb 3g. After a year of owning and using this Ipod I kind of just stopped and left it in some dark space in my room, only a few weeks ago did I pull it out excited for the new software updates. But when I tried to update it again and again it said no update available, well I thought that's rather queer Itunes is acting like my Ipod is a 2g. After this an eerie suspicion grew in my head that what if my Ipod is a 2g. So i checked the serial code and generation and found that the dreadful reality was that it is a 2g, I dug through a pile of receipts and found that it stated that I had purchased and Ipod 3g and paid the correct price for it and everything. So my question is could a get my correct product considering that i paid the price but got a different and cheaper product, by the way I do happen to have a warranty on my prodcut but it actuall ends in a month.

Apple didn't make a 3rd gen 8gb ipod touch. They just updated the software, not the hardware on that size, and the 32gb and the 64gb were the ones with different hardware. They were all part of the same time period, they just didn't all have the same capabilities. Apple put 3rd gen on some of the 8gb boxes and some said 2nd gen, but all were out at the same time as the rest of the 3rd gen so you didn't get the wrong product.

I don't understand do you mean that the iPod 2g 8gb is the same thing as the iPod 3G 8g. From what I understand if I got my correct product then I would be able to update my iOS but I can't.

There was no ipod 3g in 8gb. Didn't really exist. So basically this is what apple did. They released the third generation in ONLY 32gb and 64gb. They left the hardware for the 8gb the same as the 2nd generation which made it not upgradeable as far as newer versions of ios go. They had this out with the 3rd generation 32gb's and 64gb's. Then they made an 8gb 4th gen so they skipped it altogether, but apple marked the 8gb boxes as 3rd generation because it was out with their 3rd generation.

Unfortunately, I wouldnt expect much to be done since you noticed it a year or so after your purchase. Something like this would be very difficult to prove (not impossible though). It is not likely at all a manager would exchange your iPod based solely on your story. A good way to find out though is to see if the store took an inventory adjustment of those SKUs the week after your purchase. The big problem with this is some stores take hits on iPods fairly often and proving that a stores' inventory adjustment is related to your particular issue is difficult. Just a heads up, most managers may not even agree to look into your issue like this...
