I purchased Call of Duty Elite when I purchased MW 3. The lady that sold it to me said I would get all the map packs for a year. The new maps are out and I cannot download them, it says I need purchase COD Elite premium. I entered the code back in November and I thought that was what I purchased.

The lady was correct; purchasing Call of Duty Elite should give you access to all of the map packs that have already been released and that will be released in the coming months. If you entered the code properly, you should be prompted in-game to download the map packs that are already out.
I would check to make sure your Elite is actually showing up as Premium. You can do this by loading Call of Duty Elite on your console and looking at the subheading near the top. There should be some indication that you are a Premium level user if you've redeemed your code. Also, I would make sure you are logging in with the correct user account on your console as that could be another cause of it not showing up.

I JUST PURCHASED THE CALL OF DUTY ELITE PREMIUM PAC, I ASKED FOR THE THE PS3 VERSION, AND I GOT THE ONE FOR XBOX 360 IS THERE ANY WAY I CAN EXCHANGE MY REDEEM CODE ONLINE IN ORDER TO BE ALBE TO PLAY? OR DO I HAVE TO GO BACK TO THE STORE?

Unfortunately, digital product like that is non-returnable but you certainly could consult with the store as they might be able to do something. With situations like these the sooner you can go back in the better as they may recall the interaction and be able to factor that in.
