I think (and this is just my opinion) that the manager did not know what he was talking about. Without regards to download dates and whatnot, Apple would not intentionally install software from other companies onto their computers without authorization. Being that Adobe (Flash) and Microsoft (Silverlight and Skype) are not exactly on the best of terms with Apple, I would guess that those programs do not natively come preloaded on Apple computers. I can also only guess that Mr. Dean Russel would not fax/mail you his statement because that is a legal issue. If you were to bring it back to the store, then he might be able to work something out with you. But that is between you and Best Buy.

Haha, this is not a matter of me being satisfied with your explanation. I don't work for Best Buy so I couldn't care less. I was merely playing on your statement that you automatically assumed that Best Buy had committed fraud against you. I was entertaining the thought that maybe this was just an accident, but I really don't know because I wasn't there. I just love it when people cry fraud at the first sign of trouble. My job is to teach college students to see all aspects of a problem before making a sound decision or judgment. This forum could use a lot of it.

 

I seriously hope your issue is resolved, but only a Community Connector can do that. I'm merely a passing spectator.

CrimsonRain it is not nice of you referring to someone as a kid, i mean we do live in a civilized society where he or she has the right to express his or her opinion. As such if you desagree with somebody, the best to do is to keep quiet...no need quarreling...

It is your full right to think as Mr. Dean Russel. But to me it is quite unbelievable, i mean i cannot tell my 5 years old boy to stay away from school and when the time comes to justify why he stayed away from school, i am unable to write a statement to his teacher...Someone cannot say something for his/her defense, then not being able making a statement on what he/she said earlier...That is the reason why, when a police officer arrests a person, he always makes it clear to the concerned that "whatever he/she says could be used against him/her... "...Please we should stop telling lies...I always tell my small boy that no matter what he has done, he should always say the truth to me (his mum as well)

My conclusion on this issue is that Mr. Dean Russel is a big lier...What a pity for an adult, a family father as well, i guess.
Hence, my present interest is to stop BB from abusing customers...period.

P.S. the computer was well packed in, there was no external (on the box) sign of usage.Just by looking at the box, there was no sign that the content (computer) was a used stuff.

The proper definition of a Brand New Computer, or any Brand New Electronics appliance. Is a unit that has Never EVER been Used. Not ever used for ANY reason what-so-ever. NO Excuses, NO Exceptions, NO Rationalizations!  

 

Because it is usually difficult to hide the signs of previous use on an allegedly New computer. The favorite excuse of scoundrels who are trying to pass off Used computers, as if they are New. Is to claim that the computer has been "Optimized" in some way.  

 

The subterfuge of claiming that the computer has been Pre-optimized. Has the additional advantage, for the dishonest seller, of enabling them to claim that this is actually done for the buyers benefit. They would have you believe that they are actually doing you a favor. Then, to add insult to injury, the scoundrel will sometimes charge you extra for the Pre-optimized computer. So that you often end up paying more for a previously used second hand computer, than the price of a Truly Brand New computer.  

 

The only way to be confident that you are getting a Truly Brand New unit. Is to only accept merchandise that is still inside of its original Never EVER Opened Factory SEALED Retail packaging. In an original package that doesn't show ANY signs of tampering.  

 

Not every computer that is labeled as having been "Optimized" is necessarily an otherwise used computer. That is being sold by a dishonest scoundrel who is intent on coning you. For example, Best Buy does legitimately "Pre-Optimize" some Brand New computers, for a fee of $99. 

 

However, there isn't any reliable way of distinguishing the Truly New but Optimized computers. From the Used second hand junk that is frequently passed off as being New and "Pre-Optimized".  

 

So for peace of mind, and to avoid unnecessary problems. It's always best to stick to Factory Sealed merchandise.  

 

Remember, it is the dishonest con artist who can always offer all sorts of reasons. For why it is OK to buy their "Opened Box" merchandise.

Optimized and use are COMPLETELY different in the eyes of the law.

This is why it is important to use NEW as the legal definition and not what you termed the "proper" definition. The "proper" definition is subjective, while the legal definition is set in stone.

There is multiple reasons for the legal definition.

1) there are items that cannot feasibly be bought unused. QA, testing and other reasons come into play. The easiest example I can think of is firearms. Every firearm has its own unique bore scoring. As such every firearm needs that scoring for tracking the guns of used in illegal manners (shootings, homicide etc).

They don't have to actually shoot the gun. They can use other means to get the scoring, but costs much more. This method costs a decent amount more so it is reserved for collector guns.

Likewise you have cars which the second it gets 1 mile on it they wouldn't be considered "NEW" according to your definition.

Or recalls would fall into this also

2) warranties - while these could be fixed, laws governing warranties and warranties themselves would be a lot longer to cover what "NEW" is for each item. Under the legal definition if a car is test driven, a gun fired for ballistics or a computer optimized the warranty won't start until the item is sold. Under your definition the warranty would start the second the car is driven etc. The laws protecting consumers would have to be lengthened for every item stating which is new and what makes exceptions.

Likewise I have referred many a forum members and personal friends to pre optimization (precalibration)of TVs from Value Electronics as the top calibrators will stop by the shop and offer VE a discount in calibrating as the calibrator will do multiple TVs at a time. The tv is still sold as new, but calibrated.

The key is making sure the customer knows that you have pre optimized it. If not then that is a MAJOR concern.

If BBY ever just used "pre optimized" on anything other than an item that
Matches up with the legal definition of new, then there would be a ton of press, a major lawsuit and other repercussions.
