CrimsonRain, could you please let me know how to prove it?

Will it be fine if i do post here the correspondances done with Denise from BB on this issue?
Do you really think that i will be writing in this forum if not having been abused by BB?

Well, you'd have to prove that Best Buy store in particular was attempting to sell you a used or opened product as brand new without advertising it as such. To prove fraudulent intent would be very hard. Could the computer had been opened or used before? Absolutely. Could it had been a mistake that the store failed to advertise it as such (Best Buy is required to tag items that had been opened)? This is probable. Could it had been that Best Buy store was trying to pawn off a used item as new so to not lose money? Also probable. Unfortunately, the item is out of the 14-day return and exchange policy so you can't return or exchange it. I would probably bring it back to the store and show them. The manager on duty might make an exception or offer you a solution.

Easily proven..op said the computer was bought in January... But downloads occurred before purchase date...leading to the conclusion that the MBP was used/returned.
Also, the OP could check to see if the MBP has been registered with Apple.
Looking at the receipt would show that the OP paid the new price instead of open item price = win!

Also...return policy is 30 days...45 for silver members...but will not help in this case.

When buying an open item, does the price you pay equal that of a new item? Is an open item sealed in a box when sold?
For you information CrimsonRain, 2,500 us dollars was given for a brand new 17inch macbook pro, an open item does not amount 2,500 us dollars, right? At the store in Fairborn, my girlfriend was given a used item packed and sealed in a box. As such, i am unable to tell whether BB did this by mistake or if it was done on purpose.But what i am pretty sure of is that we have been abused/cheated by BB.
I contacted the store and spoke to the manager Dean Russel and was told that the downloads originated from Apple because all BB computers are being delivered to their stores sealed in boxes; thus BB does not have the possibility repacking computers, he added...With Mr. Russel's words, i contacted Apple Denmark (Europe, where i live) and here the guys were amazed to hear that someone said that Apple is delivering computers with preloaded stuffs as FLASH, SILVERLIGHT and SKYPE...They thought i was joking, i said no, that is what i have been told by Mr. Dean Russel, manager of BB store Fairbon...Then these guys requested for a written statement confirming what i told them; a statement confirming the fact that the downloads found on my computer were preloaded from the Apple factory as Dean Russel told me earlier...It turned out that Mr. Dean Russel was unable providing me a written statement, i mean what he told me over the phone couple of days ago, he was now unable to write it down on a piece of paper and fax/mail it to me...So CrimsonRain, what is the conclusion here??
It should be noted that Apple Denmark only needed this statement from the manager in order to exchange my computer to a brand new one (a real new one)
