They can sell it as new as they aren't taking anything from the product. But if they say it is a new item they have to say that they did work to it to "preoptimize" as they put it.


Legal definition of new is just that it hasn't been sold in a retail sense or hasnt been fixed in the sense of something was wrong. Least that is how I understand it here in the US (like how GameStop sells new games that are opened up for display purposes).

Btw the GameStop lawsuit big deal was because they literally stole something out of the packaging (a code for a free download of game) and resealed it WITHOUT telling customers anything.

I can't tell you what happened, but hopefully something can be done for you

Thanks for the post but I have a question. Just how does Best Buy transmit the fact that they "preoptimized" the system to the customer so they know that this has happened to the particular product they are buying..special signage? I have never seen any such signage in my local BBY.

Yes. My store puts stickers on the preoptimized ones. But as far as I know they just have to make sure it is conveyed to the consumer by some means.

Preoptimization is supposed to be a $99 fee, but if they have no other stock besides pre opt. ones (I am not sure if they are supposed to) then they can offer the preoptimized unit at the same price as a non preoptimized one.

Sorry NCO I was wrong apparently. They don't pre opt apples according to the above posters (they would probably know more than myself in this area).

Its ok brother...you are only human after all. When I worked at Office Depot I sold a lot of Mac's and didn't know a darn thing about them. I did not lie..I just winged it!!!!:smileyhappy:

what could the kind of action be to stop BB from cheating or abusing customers ?
