I was sorry to hear you camera came back from repair with the same issue, and I can understand being frustrated with this. When you ask how long before the lemon replacement kicks in, I assume that you are referencing the no lemon policy of a Performance Service Plan (PSP). If the camera that is covered by a PSP has three qualifying repairs, and a diagnosis by an authorized service technician says a fourth qualifying repair is needed the PSP should replace the camera. A qualifying repair is when a part other than an accessory is replaced on a product, and due to this part replacement the product is determined to be repaired by the authorized service technician repairing the product.
Without actually hearing the problem with the sound it would be hard for me to make a guess as to what is causing it, but I will say that sound has never been a strong suit for consumer level Olympus cameras. In fact I will say that digital still cameras are not made to shoot high quality video, and if video is important to you I would suggest getting a camcorder. Generally speaking the mic on digital still cameras will just not perform nearly as well as the mic on a camcorder.
