Hello I bought my xbox 360 05/10/09 and it went out 01/06/11 so I went to store and they sent it out and gave me refurbished one, well that went went out to and I got another, we today I got my 4th refurbished one and I am already having problems after only using it for less then a hour, I was told 2 times that if my 3rd one failed me I would get a gift card to spend in store or a new xbox 360, but now another guy in store say they can't do that, well I want something done because I got 4 xbox 360s in two months that keep going out. What can I do? why do they tell me i can do that, my warrenty even says i have no lemon policy.. so i wasted money to buy a warrenty that just replaces my product with another that dont even last a month.

I am sorry to hear that you have had such terrible luck when it comes to your XBox 360 and the Protection Plan. I have been taking a look at the verbiage on bestbuy.com (when you add the XBox 360 to the cart and look at the Terms and Conditions of the Geek Squad Black Tie Protection) and am going to summarize what I feel is applicable to this case. What it appears that you have had done is a series of 3 "Rapid Exchanges," where they take your old unit, and immediately send you out a new (refurbished) unit to you, so that your downtime is minimized. Generally, I have not seen customers have problems with the refurbished products, as they have gone through extensive quality control measures. For the pruposes of the No Lemon policy, however, Rapid Exchanges do not count as a "qualified repair" because they are not servicing the unit in question, you are having issues with a different unit each time, instead of one that can be considered a "lemon."
With that being said, I do feel for your situation, and I personally feel that an exchange (a PSP Fulfillment) might be called for. However, how I would deal with a customer at my store does not necessarily reflect how other stores would handle the same situation. I would suggest politely talking with the Manager on Duty at your local store to see if they will be willing to perform an exchange for you. The final discresion does lie in the hands of the Manager on Duty at the time, but calmly explaining the situation should help the MOD understand your frustration.

thank you very much for posting, i am going to try a diffrent best buy sunday. the workers at the one by me have no idea what they are doing, they all say diffrent things. two geek squad agents told me that i would get a new one if my 3rd one doesnt work, one of those agents was a manger and when i asked him about it again he said they cant do that, i am done with best buy after this, i always get screwed over by them. thanks for all the info, its nice someone is trying to help, i tried looking on the site and couldnt find anything. thanks again
