While the original poster might be frustrated because they cant get their way on a return, the reciepts clearly state the restocking fee.
Any responsible consumer will research applicable fees and other information prior to a purchase.

ConnieNV, why is it best buy's fault that YOU or YOUR husband opened the box and damaged the seal? If you were in the store and you saw that box with the damaged seal can you say that THAT is the box that you would select?
I know I most certainly would not.
I am sure that I am not alone in this thought.
I call bullshyt on you. NO one opens the box to compare the unit without touching it. No one compares units without TRYING THEM OUT. Something WAS done to it. How can Best Buy know if you had it out for 10 minutes or 10 hours. When you break the seal on the box, the item is USED. PERIOD!
I do think that there are some people who treat best buy like Rent-A-Center. They purchase a Tv for superbowl or a gps for a trip and return the item when the 'event' is over. This restocking fee is a deterent for that.
I could see your anger at BEST BUY if the information was not on the reciept and in big HUGE letters at the store BUT IT IS!
Now you want them to sell an item (opened) at the same price as new all the while knowing that most people would NOT purchase the item with the broken seal (at least not for the same price as one that is pristine). So basically you want best buy to take the loss because you did not 'test' the items at the store.
IF Best BUY were to make an exception to the rule for YOU then there would be no reason to have a rule at all since everyone would have a 'reason' why the clearly stated rule did NOT apply to them.
If you have anger with anyone, you should be angry with yourself for
1. NOt doing research online regarding the GPS units so the 'choice' of which to pick would be OBVIOUS without opening the package. Most GPS units have displays AT THE STORE for you to put your grubby fingerprints all over. If you (or he) werent planning on doing that, there was really no reason to open the box as the picture is on the front of it
2. NOt reading your reciept
3. cutting your nose off to spite your face by denying yourself bargins at best buy because you did not get your way when you were clearly in the wrong
I dont know If you will ever go to Best Buy again but in the end the loss will be YOURS and not the other way around.

Please give me a break. Even if they did take it out of the box, so what. I have taking things out of the box while standing in the store just to make sure it is what I want. If the gps was not damage and everything was there so they could put it back on the shelf and sell it agian there is no reason to charge a restocking fee. Who are you to accuse someone of useing something and returning it. Because your next door neighbor killed someone does that mean you will too.
As for.... this was started because people do this all the time... is wrong. It was started because someone would order something that a store did not stock and then return it and the store would have to try and sell an item that was not very common. This is not the case with gps, laptops or cameras.
As for ......If you were in the store and you saw that box with the damaged seal can you say that THAT is the box that you would select?.... yea I can and yea I have. I wish I had a nickel for eveytime the srore clerk had told me it was fine and if there was anything wrong with it I could bring it back and you know what, out of all the times that I have done that the only time I have ever had to take it back is if I got it at fr.. (the well know electronic store) and thats eveytime I have bought an open item at fr.. but that is there fault not the customers.
This is just another way to take your money. The lesson here is we all have gotten used to companies that give us good customer service. We assume that Best buy will also do the right thing and truth is all they want is our money even if they have to take it in restocking fees. No one goes into a store asking to see all of thier leagal junk. (and they count on that) We all learn it because someone else has something like this happen and tells us about it.
